Breastfeeding mother files discrimination lawsuit

There are many types of workplace discrimination, with each instance just as serious as the next.

From our Indiana readers to those in other parts of the United States, it is important to become familiar with all types of discrimination to ensure that you are being treated appropriately at the work place.

Unfortunately, a 31-year-old woman from Pennsylvania has gone through a long ordeal with her employer related to her plan to pump breast milk during breaks as a palletizer operator.

As is her right under a provision of the 2010 Affordable Care Act, the woman had every plan to pump in a private, clean, non-bathroom space. However, this is far from what happened. She claims the company for which she worked did not follow the law, as she was first told that she must pump in a bathroom. From there, it was suggested that she do so in a locker room.

After complaining about the situation she was put in, the woman was reassigned to alternating day and night shifts that further impeded her ability to stick with a regular feeding schedule.

The American Civil Liberties Union, along with the Equal Opportunity Employment Commission, filed a civil suit on her behalf last month. This is the first lawsuit the American Civil Liberties Union has filed as a result of the breastfeeding provision included in the Affordable Care Act.

This is just one type of workplace discrimination. From age discrimination to race discrimination, there are others to be aware of. Those who have been put in this unenviable position have the right to consult with an employment law attorney.
