Indiana law on age discrimination

Discrimination in the workplace does not only happen if you are of a different race or religion. It can also happen if you are in your later years of life. This is called age discrimination.

Although there is an increase in senior workers due to a longer lifespan and fluctuating economy, there has not been a matching rise in the respectful treatment of older employees like you. Be aware of age discrimination laws in Indiana to protect your employment rights.

The definition of age discrimination

The Age Discrimination in Employment Act states that an employer cannot discriminate against someone who is over 40 (until you are 75 years old, according to Indiana law). This means that your age cannot be a deciding factor in the following:

  •        Hiring
  •        Training
  •        Responsibilities
  •        Pay and benefits
  •        Promotions and raises
  •        Termination

You have the right to receive fair treatment no matter how old you are and to be just as eligible for deserved job advancement as any younger employee. The law does allow, however, for employers to favor an older employee over a younger one, regardless of their ages.

Signs of age discrimination

Age discrimination can start as early as the application process. A potential employer may pass you up for a younger applicant although that person is not as qualified as you are. If you do get hired, you may watch your coworkers rise through the company while you remain stagnant despite great performance. You may even receive a demotion or lose your job altogether for no explicable reason. Your peers may also harass you about your age or treat you differently than other colleagues.

If any of these things are happening to you at work, then you probably have an age discrimination case on your hands. Your best course of action is to speak to an employment law attorney for assistance. Going against an employer can be frightening, and you may fear for your current job or a future one. However, an experienced lawyer can help ensure the protection of all your rights.
