Beyond just a source of income to provide for your family, a job offers a sense of identity and pride for most Indianans. So, when it’s taken away, the sense of loss can be devastating. There are times when employers need to lay off workers as a result of necessary cutbacks or an employee’s poor performance, but that’s not always the case. Perfectly capable employees suffer wrongful termination all the time for reasons that run the gamut from retaliation to discrimination.
A Miami Dolphins scout has announced his intentions to file a wrongful termination lawsuit against the football team after he says he was improperly fired for working from home. The scout, who’s been with the team for 17 years, began working at home in 2004 to care for his wife, who had been diagnosed with cystic fibrosis.
Officials in the organization had been fine with the arrangement for years, but the new general manager didn’t feel the same way. Now, the scout wants to return to his job and wants health care benefits that would cover his wife’s condition.
The Americans with Disabilities Act makes it illegal to discriminate against a person because someone they are associated with suffers from a disability. If a case is brought against the Dolphins, a judge will have to determine if that’s what happened here.
Of course, this case just demonstrates one way in which employees can be wrongfully terminated.
