The federal government has passed a law that provides for up to 12 weeks of unpaid family and medical leave. This law is called the Family and Medical Leave Act, and it applies to all kinds of private employers and certain government employers. The Family and Medical Leave Act does not apply to all employees or all employers, however. In order to receive family and medical leave from your employer and be protected under the statute, you and your employer must meet certain requirements, including:

  • You must have worked for your employer for at least 12 months.
  • During that 12-month period, you must have worked a total of at least 1,250 hours for your employer. This comes out to about 25 hours per week for 50 weeks.
  • Your employer must have at least 50 employees.

If all these requirements are met, you are protected under the FMLA. You are entitled to take leave from your employer for serious medical conditions, pregnancy or temporary disability and come back from the leave to the same or similar position.
