Protecting Your Right To Care For Yourself And Your Family

While most companies have adjusted to allowing an employee to take two to three months off because of an illness, to care for a sick family member, for the birth of a child or for military service, it can be more difficult if you need to take time off intermittently to deal with a health issue.

To qualify for leave under the Family and Medical Leave Act (FMLA) you must:

  • Have worked for your employer for at least 12 months
  • Worked at least 1,250 hours during that 12-month period
  • Work for a company with at least 50 employees

If you are having difficulties because your employer isn’t letting you take leave, or is upset because you have taken your leave intermittently, our Indianapolis FMLA lawyers can help.

At the Employment Law Office of John H. Haskin & Associates, LLC, we have served employees all over Indiana for decades, helping them successfully resolve legal disputes with their employers. Our attorneys have experience with everything from settling cases before trial to bringing cases to court or before state and federal employment commissions. We are the largest law firm in the state, dedicated to representing employees.

Intermittent Leaves Of Absence

If you or someone in your family has an illness or injury that requires regular doctors’ appointments or hospital stays or may put you or a family member out of commission for a couple of weeks at a time, you do have the right to use FMLA time for these issues. However, your employer may not be too happy about having an employee who is absent from work so often or who seems “so unreliable” regardless of your actual productivity.

If your employer starts disciplining you for taking this time off, or if you are gone for a short period and are not allowed to return to your job, this is considered retaliatory behavior and is illegal. Our attorneys will review your company’s leaves of absence policy to determine whether it complies with FMLA guidelines and whether you have been treated unfairly.
