Indiana Employment-At-Will And Retaliatory Discharge
Indiana follows the common law employment-at-will doctrine. This means that under most circumstances, employment is “at-will” and can be terminated at any time, by the employer or the employee, and for most any reason — or no reason at all. However, certain retaliatory discharges are considered exceptions to the employment law doctrine and are unlawful.
- Frampton claims: An employer cannot legally fire you for filing for a workers’ compensation claim following an on-the-job injury. If an employer has discharged you in retaliation for workers’ compensation benefits, you may be entitled to legal remedy for the retaliatory discharge (frequently referred to as a Frampton claim).
- McClanahan claims: An employer cannot legally terminate you for refusing to commit an illegal act that could potentially subject you to civil or criminal liability. For example, an employer cannot discharge you for refusing to “cook the books” or “drive hot.” If your employer terminated you in retaliation for refusing to commit such conduct, you may be entitled to legal remedy for the retaliatory discharge (commonly referred to as a McClanahan claim).
